General Provisions

Non-Governmental Organization “Center for Environmental Initiatives “Ecoaction”, registered and operating in accordance with the requirements of the legislation of Ukraine (hereinafter – “Ecoaction”), assumes obligations regarding the protection of personal data of all persons who have visited this website Just Transition in Ukraine (hereinafter – “Website”), and therefore strives to protect the confidentiality of personal data (information or set of information about an individual who is identified or can be identified), thereby creating and providing the most comfortable conditions for using the Website for every user. This Privacy, Personal Data Protection and Cookie Policy (hereinafter – “Policy”) sets out the procedure by which Ecoaction processes personal data, the types of personal data collected, the purposes of using such personal data, Ecoaction’s interaction with third parties, security measures to protect personal data, conditions for access to personal data, the procedure for using cookies, as well as contact information for the user regarding obtaining access, making changes, blocking or deleting their personal data and addressing any questions that may arise regarding personal data protection practices or the use of cookies.

Collection and Use of Personal Data

When a user uses the Website Just Transition in Ukraine, user data is processed, specifically:

  • cookies;
  • IP addresses;
  • parameters and settings of internet browsers (User-agent);
  • information you entered when filling out forms on our website.

When visiting the Website, all system logins are logged. Other information regarding user traffic is not processed or stored. In any case where non-mandatory information is requested, the user will be notified at the time of collection. Ecoaction does not collect personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. Ecoaction collects website visit statistics. The information may include details about the connection, traffic, user browser, as well as the date, time, duration of internet session, and presence on the Website. Ecoaction also collects information that visitors fill in forms on our website; this information may also include details such as name, contact information, thematic preferences for newsletters, and more.

Visitor data is added to Google Analytics data, which provides aggregated data from which it is impossible to identify individual visitor information.

Processing of Personal Data

Processing and storage of provided personal data is carried out in data centers housing equipment that ensures the functioning of the Website services. Provided personal data is processed and may be stored in a personal database or a separate table of the Website database. The place of storage and processing of personal data available to the organization is located at: Ukraine, Kyiv, 36E Yevhena Konovaltsia St.

Purposes of Using Personal Data

Personal data of the user is used to ensure the provision of Website internet services, information/news exchange, as well as relationships in advertising and communication.

Personal Data Retention Period

Personal data is stored for a period no longer than necessary in accordance with the purpose of its processing. After the data subject ceases to be a user of the Website by deleting their account on the Website, or opts out of receiving newsletters to which they previously subscribed, their personal data is also automatically deleted.

Use of Cookies

A cookie is a text file or files containing a small amount of information sent to a web browser and stored on the user’s device. Such devices may include a computer, mobile phone, or other device through which the user visits the Website. Ecoaction’s use of these services is necessary for prompt analysis of Website visits, internal and external evaluations of attendance, depth of view, and user activity. Ecoaction does not store or process data received from these services. Accordingly, if for any reason a user does not wish these services to access their personal data, they can voluntarily log out of their account/profile and clear cookies via their browser.

Protection of Minors

The Website is not intended for minor users. Ecoaction takes security issues very seriously, especially regarding minors, and urges parents to explain online safety issues to their children, as well as the specific purpose and need for using the Website.

Ecoaction’s Interaction with Third Parties Regarding Personal Data

Ecoaction does not transfer personal data to third parties, except when such transfer is required by law, requested by the personal data subject, or in other cases specified in this Policy. Ecoaction understands that personal information is valuable and an integral part of personal non-property rights of any individual, thus taking all possible measures to protect personal information voluntarily and consciously shared by users. The Website may contain links to other websites (strictly for informational purposes). When following a link to other websites, this Policy will not apply to them. Therefore, Ecoaction recommends reviewing the privacy and personal data policy of each website before transferring any personal data that could identify you.

Confidentiality of Personal Data Subject Activity on the Website

Information about user activity (traffic) on the Website passing through the user’s network or email is protected in accordance with applicable legislation.

Personal Data Protection

Ecoaction employs generally accepted standards of technological and operational protection of information and personal data against loss, misuse, alteration, or destruction. However, despite all efforts, Ecoaction cannot guarantee absolute protection from all threats arising beyond Ecoaction’s control. Ecoaction ensures the implementation of all appropriate confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or unlawful disclosure or processing of such information and data, as well as accidental loss, destruction, or damage. Ecoaction provides access to information and personal data only to authorized employees who have agreed to maintain confidentiality in accordance with Ecoaction’s requirements. Disclosure of personal data without the consent of the data subject or their authorized representative is permitted in cases specified by law, and only (if necessary) in the interests of national security, economic well-being, and human rights.

Conditions for Access to Personal Data

The procedure for third-party access to personal data is determined by the conditions of user consent granted to the personal data controller, or in accordance with legal requirements. The user has the right to receive any information about themselves from any subject of personal data relationships, provided they specify their full name, place of residence (stay), and details of the identification document submitting the request, except in cases established by law. User access to their own data is provided free of charge.

Rights of the Personal Data Subject

Ecoaction hereby informs the user of their rights as a personal data subject, as regulated by the Law of Ukraine “On Personal Data Protection”, namely:

1) to know about the sources of collection, location of their personal data, purpose of processing, location or residence (stay) of the controller or processor of personal data, or to issue an appropriate mandate to obtain this information to authorized representatives, except in cases established by law;

2) to receive information regarding the conditions for providing access to personal data, including information about third parties to whom their personal data is transferred;

3) to access their personal data;

4) to receive a response no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, as to whether their personal data is being processed, as well as to receive the content of such personal data;

5) to submit a reasoned demand to the personal data controller objecting to the processing of their personal data;

6) to submit a reasoned demand for the modification or destruction of their personal data by any controller or processor, if the data is processed unlawfully or is inaccurate;

7) to protect their personal data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, failure to provide, or untimely provision, as well as protection against providing information that is inaccurate or discredits the honor, dignity, and business reputation of an individual;

8) to file complaints regarding the processing of their personal data with the Authorized Human Rights Commissioner of the Verkhovna Rada of Ukraine or to a court;

9) to apply legal remedies in case of violation of legislation on personal data protection;

10) to enter reservations regarding the restriction of the right to process their personal data when giving consent;

11) to withdraw consent to the processing of personal data;

12) to know the mechanism of automatic personal data processing;

13) to be protected against an automated decision that has legal consequences for them.

Policy Changes

Amendments and additions may be made to this Policy periodically and without prior notice to the user, including when legislative requirements change. In the event of material changes to this Policy, Ecoaction will post a notice on the Website specifying the effective date of such changes. If you do not decline them in writing within the specified period, it will signify your agreement with the relevant Policy changes.
